Welcome to CoachSync! These Terms of Service ("Terms") govern your access to and use of the services, software, and website provided by CoachSync, Inc. ("CoachSync", "we", "us", or "our"). By using our product, you agree to these Terms. If you do not agree, do not use the Service.

1. Use of the Service

a. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Service. If you are accessing the Service on behalf of a gym, team, or coaching organization, you represent that you have the authority to bind that entity to these Terms.

b. Account Registration

To use our Service, you must create an account. You agree to provide accurate and complete information and keep your account credentials secure. You are responsible for all activity under your account, including any programs created or athletes managed.

c. Acceptable Use

You agree not to misuse the Service, including (but not limited to):

• Engaging in illegal activity
• Attempting to gain unauthorized access to other users' programs or athlete data
• Interfering with or disrupting the Service or related networks
• Using the Service to distribute harmful training advice or programs
• Circumventing usage limits or accessing paid features without proper subscription
• Using the Service to create programs for activities outside of Olympic weightlifting without our consent

2. Subscriptions and Billing

Some features of the Service require a paid subscription. By subscribing, you agree to pay applicable fees and authorize us (or our third-party payment processor) to charge your payment method on a recurring basis unless canceled.

You may cancel your subscription at any time, but payments are non-refundable except as required by law. Access to paid features will continue until the end of your current billing period.

3. Intellectual Property

CoachSync retains all rights, title, and interest in the Service, including all related software, AI models, training methodologies, designs, trademarks, and content. You may not copy, modify, distribute, or create derivative works based on our Service without our prior written consent.

You retain ownership of any training programs, athlete data, or coaching content you create through the Service ("Coach Content"). By using our AI features, you grant us a limited license to process your Coach Content solely to provide and improve the Service. We will never share your specific programs or athlete data with other users without your explicit permission.

4. AI-Generated Content

Our Service uses AI to assist in program generation and coaching recommendations. While we strive for accuracy, AI-generated content should always be reviewed and validated by qualified coaches. You acknowledge that:

• AI suggestions are not a substitute for professional coaching judgment
• You are responsible for ensuring all programs are safe and appropriate for your athletes
• CoachSync is not liable for injuries resulting from AI-generated programs

5. Privacy and Athlete Data

We take athlete privacy seriously. You agree to:

• Only input athlete data for individuals you have permission to coach
• Comply with all applicable privacy laws regarding athlete information
• Not share login credentials that would give unauthorized access to athlete data

6. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, engage in harmful coaching practices, or pose a risk to the platform or other users. Upon termination, your right to use the Service will end immediately, but you may export your program data within 30 days.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the Service will be error-free, uninterrupted, or that AI-generated programs will produce specific training results.

8. Limitation of Liability

To the maximum extent permitted by law, CoachSync shall not be liable for any indirect, incidental, special, or consequential damages, including any injuries to athletes, loss of competitive opportunities, or loss of coaching revenue arising from your use of the Service.

Our total liability for any claims relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless CoachSync, its officers, directors, employees, and affiliates from any claims, damages, or expenses (including attorneys' fees) arising from your use of the Service, your coaching activities, or your violation of these Terms.

10. Modifications

We may update these Terms from time to time. We'll notify you of significant changes via the Service or email. Continued use after changes means you accept the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Any legal action must be filed in the state or federal courts located in Delaware.
